Adoption Tails Submission

† BY CHECKING THIS BOX, I REPRESENT AND WARRANT THAT I HAVE OBTAINED THE CONSENT OF THE LEGAL GUARDIAN OF EACH MINOR THAT IS INCLUDED IN THE ENTRY (DEFINED BELOW), IF ANY, AND AGREE TO BE BOUND BY THE RULES SET FORTH BELOW. MY ACCEPTANCE OF THE RULES CONSTITUTES AN AGREEMENT BETWEEN ME AND THE SPCA OF BREVARD (DEFINED BELOW). Rules - By submitting a photo or video (the "Entry"), submitter confirms that (i) he/she is at least 18 years of age and has reached the age of majority in the jurisdiction in which he/she resides; (ii) he/she is the sole owner of the Entry or has received permission from the owner to submit it on his or her behalf; (iii) he/she is the author of the text contained in the submitted caption; (iv) he/she has received permission to use the name of each person appearing in the Entry from such person if at least 18 years of age and having reached the age of majority in the jurisdiction in which such person resides or from the legal guardian of any minor appearing in the Entry; and (v) he/she fully understands, accepts and agrees to be bound by these rules. - Entries may not include (i) images and names of any person other than submitter unless (a) such person is at least 18 years of age, has reached the age of majority in the jurisdiction in which the such person resides, and has consented to such person’s image or name being used or (b) such person is under 18 years of age and the legal guardian of such minor has consented to the minor’s image and name being used; (ii) images of any animal unless the owner of such animal is at least 18 years of age, has reached the age of majority in the jurisdiction in which such owner resides, and has consented to the animal’s image and name being used; or (iii) any images or text that may infringe upon the intellectual property rights of a third party. - By submitting the Entry and story, you give the SPCA of Brevard an irrevocable perpetual royalty-free, sub-licensable, non-exclusive, worldwide right to use your first name, text and/or Entry for any purpose, including fundraising, to promote the SPCA of Brevard’s mission protecting and providing a voice to the homeless animals of Brevard County. - By submitting the Entry and story, you agree that in no event shall the SPCA of Brevard be liable for any losses, expenses or damages (including third party complaints or litigations) resulting from the SPCA of Brevard’s use of your name, text and/or Entry. You further agree to indemnify, defend and hold harmless the SPCA of Brevard from and against any and all costs and/or expenses that may arise out of any use of your name, text and/or Entry by the SPCA of Brevard.
